How This Document Works
This Terms of Use ("Terms") is a legally binding agreement between you ("you," "your," "User") and Seven Pines Collective, LLC ("Sproutsi," "we," "us," "our"), the operator of Sproutsi at sproutsi.co and any related applications or services (collectively, the "Platform").
These Terms govern your access to and use of the Platform. They must be read alongside our Privacy Policy, which explains how we collect, use, and protect personal information. Defined terms used in the Privacy Policy carry the same meaning here.
Section 2
1. Acceptance of These Terms
By creating an account, placing an order, or otherwise accessing or using the Platform, you confirm that:
If you do not agree to these Terms, you may not access or use the Platform.
- You are at least 18 years of age.
- You have read, understood, and agree to be bound by these Terms and our Privacy Policy.
- You are acting as a parent or legal guardian of the child for whom you are creating a book, or you have explicit authorization from that child's parent or legal guardian.
- Where you are providing information about a child, you have full authority to consent on that child's behalf.
- You are entering into this agreement on behalf of yourself individually, not on behalf of any company or organization unless you have separately agreed to Sproutsi's enterprise terms.

2. Eligibility and Account Registration
2.1 Age Requirement. The Platform is intended for use by adults aged 18 and over. We do not permit children to create accounts or use our Platform independently. If we become aware that a person under 18 has created an account, we will terminate that account and delete any associated data.
2.2 Account Accuracy. When creating an account you must provide accurate, current, and complete information. You are responsible for maintaining the accuracy of your account information and for all activity that occurs under your account. You must notify us immediately at [support@sproutsi.com] if you believe your account has been compromised.
2.3 One Account Per Order. Each account is for the personal use of the individual who creates it. You may not create accounts on behalf of others without their explicit consent, except where you are acting as the parent or guardian of a minor in connection with creating that minor's personalised story.
2.4 Account Termination. You may close your account at any time by contacting us at [support@sproutsi.com]. Upon closure, we will delete your child's personal information within [30 days] in accordance with our Privacy Policy (Section 7). Certain information may be retained where required by law (for example, financial records).

3. Description of the Service
3.1 What Sproutsi Does. Sproutsi creates personalised, AI-generated illustrated storybooks for children. Each book is uniquely produced using information you provide about your child, including their name, age, a photograph, and details about a challenge or situation they are navigating.
Our story generation pipeline uses artificial intelligence to analyze uploaded photographs, generate a clinically grounded narrative brief calibrated to your child's age and challenge, write a therapeutically structured story, and create custom illustrations matched to your child's appearance and story scenes.
The finished product is delivered as a digital eBook (PDF). A physical hardcover book may be ordered after you have reviewed and approved the eBook.
3.2 Therapeutic Disclaimer. Sproutsi's stories are grounded in evidence-based therapeutic principles including cognitive behavioural therapy (CBT), play therapy, bibliotherapy, somatic regulation, and similar frameworks.
- Sproutsi is not a licensed mental health provider.
- Sproutsi does not provide clinical therapeutic services, diagnosis, or treatment.
- A Sproutsi story is not a substitute for professional mental health support.
- If you have concerns about your child's emotional wellbeing, development, or behaviour, please consult a qualified healthcare or mental health professional.

4. AI-Generated Content: Disclosures and Limitations
4.1 Nature of AI-Generated Output. Every Sproutsi book, including its text, story structure, and illustrations, is generated by artificial intelligence. By using our Platform, you acknowledge and agree to the following disclosures.
4.2 AI Disclosure on Finished Book. All Sproutsi books include an AI disclosure on the copyright page stating that the story, characters, and illustrations were generated by artificial intelligence under the direction of Sproutsi's therapeutic authoring system. This disclosure cannot be removed.
4.3 Quality Review: Your Responsibility. You are responsible for reviewing the digital eBook proof carefully before ordering a physical book.
Errors present in the eBook proof that you approve, whether explicitly or by proceeding to purchase, do not constitute grounds for a refund or replacement of the physical book. See Section 8 (Returns and Refunds).
- The story text is generated by an AI language model, not written by a human author.
- The illustrations are generated by an AI image generation model. They are artistic interpretations, not photographs or photorealistic renderings.
- While the AI uses your child's photograph to match the illustrated hero's appearance, the resulting illustrations will not be an exact likeness. Minor and sometimes significant deviations from the child's actual appearance are inherent to the technology and are not defects.
- AI generation may occasionally produce unexpected, imperfect, or inconsistent results. This is a known characteristic of current AI technology.
- The story and illustrations are created uniquely for each order. You will receive a proof (eBook) to review before committing to a physical hardcover.
- You should check that the child's name is spelled correctly throughout, the story's emotional tone and therapeutic focus are appropriate for your child, the illustrations are suitable and acceptable to you, and there are no errors in the dedication page personalisation.

5. Photo Uploads: Rules and Restrictions
5.1 Permitted Photos. You may upload photographs of the child who is the subject of the story (the "hero") and named supporting characters (for example, a sibling, parent, or friend) whose appearance you wish to include in the illustrations, provided you have that person's consent or, if a minor, their parent or guardian's consent.
5.2 Prohibited Photo Content. You must not upload photographs that violate the restrictions below.
We reserve the right to reject, delete, or refuse to process any photograph that violates these rules, and to cancel the associated order with a full refund in such cases.
5.3 Consent for Supporting Character Photos. If you upload a photograph of an adult supporting character (for example, a parent, grandparent, or friend), you confirm that you have obtained that person's explicit consent to use their likeness for this purpose. Sproutsi is not responsible for any claims arising from your upload of a third party's image without consent.
5.4 Photo Handling. Your uploaded photographs are handled in accordance with Section 5 of our Privacy Policy ("Children's Photographs: Special Handling").
- Do not upload images depicting anyone other than the intended story subject without their explicit consent or their guardian's explicit consent.
- Do not upload nudity, sexual content, or any material that could be considered exploitative of children.
- Do not upload images depicting illegal acts, harm, abuse, or violence.
- Do not upload photos containing third-party copyrighted characters, brand logos, or trademarked imagery.
- Do not upload photos digitally manipulated to misrepresent appearance in ways intended to deceive our AI systems.
- Do not upload images belonging to a person who has explicitly objected to their image being used in this context.
- Photos are used exclusively to extract appearance descriptors for illustration prompts.
- Photos are never embedded in the finished book.
- Original photos are deleted from our servers within [30 days] of generation completion.
- No biometric identifiers or facial geometry data are retained.

6. Acceptable Use and Prohibited Conduct
6.1 Permitted Use. You may use the Platform solely to create personalised storybooks for children in your care, for personal and family use. Your use of the Platform must comply with all applicable laws and regulations.
6.2 Prohibited Conduct. You must not use the Platform in the ways listed below.
6.3 Safeguarding Flag. Our clinical AI pipeline includes a safety evaluation at the story generation stage. If the information provided suggests a potential safeguarding concern, such as references to abuse, neglect, or domestic violence, the pipeline will halt automatically and no story will be generated. You will be notified and invited to contact us. We may, in serious cases, refer concerns to appropriate authorities as required by applicable law.
- Use the Platform for any commercial purpose without our prior written consent, including reselling, sublicensing, or distributing books created on the Platform.
- Attempt to create content that sexualises, exploits, demeans, or endangers children.
- Submit challenge data that describes abuse, neglect, or domestic violence involving the child. If your situation involves safeguarding concerns, please contact a qualified professional directly.
- Use the Platform to infringe the intellectual property rights of any third party.
- Attempt to reverse-engineer, scrape, or access our AI models, prompts, or systems.
- Create multiple accounts to circumvent restrictions, abuse free trials, or manipulate our service.
- Submit false or misleading information about a child's identity or situation.
- Use the Platform in any way that could harm, threaten, or exploit children.

7. Intellectual Property
7.1 Your Licence to Use the Book. Upon full payment and your approval of the eBook proof, Sproutsi grants you a personal, non-exclusive, non-transferable licence to download, store, and view the digital eBook for personal and family use, print the eBook for personal use, and share the eBook with immediate family members.
This licence does not include the right to reproduce, publish, sell, or commercially exploit the book or any portion of it; distribute the book publicly, including online sharing outside immediate family; create derivative works based on the book; or remove or alter the Sproutsi copyright notice or AI disclosure on the copyright page.
7.2 Ownership of AI-Generated Content. The copyright status of AI-generated content is an evolving area of law. As of the date of these Terms, the U.S. Copyright Office has clarified that purely AI-generated content is not eligible for copyright protection under current law.
To the extent that human creative contributions by Sproutsi, including prompt design, pipeline architecture, and therapeutic framework, give rise to protectable rights, those rights are owned by Seven Pines Collective, LLC.
Sproutsi does not claim copyright in the AI-generated story text or illustrations as such. You own your child's photograph and any personal information you provide. By uploading a photograph you grant Sproutsi a limited, non-exclusive licence to process that photograph solely for the purpose of generating your book.
You are encouraged to seek independent legal advice if you wish to understand your rights in relation to a specific book.
7.3 Sproutsi Platform and Brand. The Sproutsi name, logo, brand identity, website design, technology, and all non-AI-generated content on the Platform are the intellectual property of Seven Pines Collective, LLC. You may not use any of these without our prior written consent.

8. Payment, Pricing, and Returns
8.1 Pricing. Current pricing is displayed on the Platform at the time of purchase. Prices are subject to change without notice, but changes will not affect orders already placed. All prices are in USD unless otherwise stated.
8.2 Payment Processing. Payments are processed by [Stripe] or another third-party payment processor. We do not store your payment card details. By placing an order, you agree to the payment processor's terms of service. Payment is required in full at the time of order.
8.3 eBook Delivery. Your digital eBook will be delivered to your registered email address and made available for download in your account within approximately [2 hours] of order completion. If you do not receive your eBook within [24 hours], please contact us at [support@sproutsi.com].
8.4 No Returns on Personalised Products. Because each Sproutsi book is uniquely created for an individual child, we do not accept returns or offer refunds on completed digital eBooks that have been delivered and accessed or on printed hardcover books that have been manufactured and shipped.
Before ordering a hardcover book, you will be required to review and confirm your eBook proof. This review step is your opportunity to identify any issues. Once you confirm the proof and order the hardcover, you accept the book as approved.
8.5 Exceptions: When We Will Offer a Remedy. We will offer a replacement or refund if the book you receive is materially different from the approved eBook proof, not including minor AI variation, if the physical book is damaged or defective upon arrival, or if a technical error on our part caused the wrong book to be delivered.
To request a remedy, contact us at [support@sproutsi.com] within [14 days] of receiving your order, with a clear description and photographic evidence. We will, at our discretion, provide a replacement or refund. We will not require you to return a defective book.
8.6 AI Variation is Not a Defect. The characteristics below are inherent to AI-generated content and do not constitute defects entitling you to a refund or replacement.
- Illustrations that do not precisely match the child's physical appearance.
- Minor inconsistencies in character appearance across different pages.
- Stylistic choices in colour, composition, or line work.
- Minor trim or bleed variations in the printed product.

9. Privacy, Data, and Children's Information
9.1 Privacy Policy. Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please read our Privacy Policy carefully before providing any information about your child.
Our Privacy Policy explains what information we collect about you and your child, how we use that information including in our AI generation pipeline, who we share it with including our AI API providers, how long we retain it, and your rights as a parent or guardian including the right to access, correct, and delete your child's data.
9.2 COPPA Compliance. Sproutsi is operated as a service directed to parents and guardians. We comply with the Children's Online Privacy Protection Act (COPPA) and its 2025 amendments. We do not knowingly permit children under 13 to use the Platform independently. All child information is provided by, and with the verifiable consent of, a parent or legal guardian.
9.3 Third-Party AI Processing. Your child's information, including photograph-derived appearance descriptors and challenge data, is transmitted to third-party AI API providers, including Anthropic and an image generation API provider, as an essential part of delivering our service. These providers are bound by data processing agreements that prohibit them from using child data for any purpose other than processing your order. By using Sproutsi, you consent to this data transmission as described in Section 4 of our Privacy Policy.

10. Disclaimers and Limitation of Liability
10.1 Service Provided "As Is." The Platform and all content generated through it are provided on an "as is" and "as available" basis without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, Sproutsi disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement; that the service will be uninterrupted, error-free, or free from harmful components; and that any AI-generated content will be accurate, complete, appropriate, or meet your expectations.
10.2 Therapeutic Outcomes. Sproutsi does not warrant or represent that its stories will produce any particular therapeutic outcome for any individual child. Story effectiveness varies by child, context, and how the book is used. Sproutsi expressly disclaims any warranty that its stories will resolve or alleviate any emotional, developmental, or behavioural challenge.
10.3 Limitation of Liability. To the fullest extent permitted by applicable law, in no event will Seven Pines Collective, LLC be liable for any indirect, incidental, special, consequential, or punitive damages; any loss of profits, data, goodwill, or business opportunity; or any damages arising from your use of the Platform, the content of any AI-generated book, or your reliance on the Platform for any therapeutic purpose, even if Sproutsi has been advised of the possibility of such damages. Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform will not exceed the amount you paid for the order giving rise to the claim.
10.4 Indemnification. You agree to indemnify, defend, and hold harmless Seven Pines Collective, LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or relating to your breach of these Terms, your use of the Platform in violation of applicable law, any information you provide on the Platform including photos uploaded without proper consent, or any claim by a third party arising from your use of the Platform.

11. Third-Party Services and Links
11.1 Third-Party Providers. Sproutsi relies on third-party service providers to deliver its service, including AI model APIs, image generation APIs, payment processors, and cloud hosting providers. These providers have their own terms of service and privacy policies. Your use of Sproutsi constitutes acceptance that data necessary to deliver your book will be processed by these providers, as described in our Privacy Policy (Section 4).
11.2 Links to Third-Party Websites. The Platform may contain links to third-party websites. These links are provided for convenience only. Sproutsi does not endorse and is not responsible for the content, privacy practices, or terms of any third-party site. Visiting a linked site is at your own risk.

12. Changes to These Terms
We may update these Terms from time to time to reflect changes in our service, applicable law, or business practices. We will notify you of material changes by sending an email to your registered address at least [30 days] before the changes take effect and posting a prominent notice on the Platform.
Where a change materially affects how we process children's data, we will also update our Privacy Policy and obtain fresh parental consent where required. Your continued use of the Platform after the effective date of any changes constitutes acceptance of the updated Terms. If you do not accept the updated Terms, you must stop using the Platform and may close your account.
These Terms and the Privacy Policy will always display their version number and effective date. The current version of each document always controls.

13. Governing Law and Dispute Resolution
13.1 Governing Law. These Terms are governed by and construed in accordance with the laws of the State of [Delaware / your state of incorporation], without regard to its conflict of law principles. To the extent that any provision of these Terms is inconsistent with applicable law, that provision will be modified to the minimum extent necessary to comply.
13.2 Informal Resolution. Before initiating any formal legal proceeding, you agree to contact us at [legal@sproutsi.com] and give us [30 days] to attempt to resolve the dispute informally. Most issues can be resolved quickly and without formal process.

13.5 Small Claims. Notwithstanding Section 13.3, either party may bring a claim in small claims court for disputes that qualify under applicable rules, provided the claim remains in small claims court and does not become a class action.

14. General Provisions
14.1 Entire Agreement. These Terms, together with the Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and Sproutsi regarding your use of the Platform and supersede all prior agreements.
14.2 Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
14.3 Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
14.4 Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction in connection with a merger, acquisition, or sale of substantially all our assets.
14.5 Force Majeure. Sproutsi will not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, government actions, internet outages, or failures of third-party service providers.
14.6 No Partnership. Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and Sproutsi.
